Property Policy

In addition to our general posting rules, all property ads posted on Hangout Luton must adhere to the following policies:

Legal Obligations

  • Users listing or responding to our property ads are responsible for complying with all applicable laws and regulations.
  • Ensure you are aware of your legal obligations, which can vary based on the property’s location in the UK and the type of tenancy or tenant. While we can’t list every law or regulation, failing to meet legal obligations may lead to the removal of your ad from Hangout Luton.

Listings

  • Only one listing per room and/or property is allowed.
  • Each listing should detail only one property.
  • Listings for rooms and/or properties that are not available are prohibited.
  • All listed properties must be available for viewing.
  • You must legally have the right to offer the property for rent/sale and ensure it doesn’t breach any law, agreement, or contract.
  • Necessary consents must be obtained if required from any third party, such as mortgage suppliers or freeholders.

Responsibilities

  • Landlords must comply with responsibilities as outlined in the laws of England and Wales, Scotland, and Northern Ireland.
  • Responsibilities include providing Landlord Gas Safety Records, ensuring electrical safety, and protecting tenants’ deposits in government-approved schemes (for assured shorthold tenancies).

Professional Landlords and Real Estate Agents

  • Must declare if they are acting as an agent.
  • Advertisements must comply with National Trading Standards, including council tax band, property price, and tenure information (for sales).
  • Rental ads can specify preferred tenant types but must not discriminate based on protected characteristics under the Equality Act 2010.
  • Ads that violate the Equality Act, such as stating “no DSS” or “no housing benefit”, will be removed.
  • Listings must not specify “no children”.

Fees

  • In England and Wales, only permitted fees under the Tenant Fees Act 2019 may be requested.

EPC Requirements

  • All domestic rental properties must have an Energy Performance Certificate (EPC), and a copy must be provided to tenants.
  • Properties rented in the private sector must comply with the Minimum Level of Energy Efficiency standard (EPC band E).

Discounted/Free Accommodation

  • Listings offering accommodation in exchange for services, including ‘sex for rent’ arrangements, are illegal and will be removed.

Flatmates and Lodgers

  • Ads for flatmates or lodgers can specify the type of person sought if the “small premises exception” applies, without discriminating based on race.
  • If expressing a preference, provide an explanation focusing on the current occupants.

Additional Considerations

  • Properties outside the UK must be posted in the Holiday Rentals or International subcategories.
  • Caravans for rent should be advertised in the Holiday Rentals category.
  • Any income over £1,000 from self-employment or more than £2,500 from renting out property must be reported to HMRC.
